1. Introduction

Welcome to Freeways UK. These Terms and Conditions ("Terms") govern your use of our courier services, website, and any related applications (collectively, the "Services"). By using our Services, you agree to these Terms.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you must not use our Services. We recommend that you print a copy of these Terms for future reference.

These Terms constitute a legal agreement between you and Freeways UK, a company registered in the United Kingdom with company number 98918759 and registered office at Studio 92 Thomas Shoals, Port Jacob, E1 4QJ ("we," "our," or "us").

2. Definitions

In these Terms, the following definitions apply:

  • "Account" means the account created by a User to access and use the Services.
  • "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
  • "Order" means a request to purchase courier services through the Services.
  • "Package" means any parcel, letter, or item entrusted to us for delivery.
  • "Recipient" means the intended receiver of a Package.
  • "Sender" means the person or entity that initiates the delivery of a Package.
  • "User" means an individual who accesses or uses the Services.
  • "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.

3. Account Registration and Use

3.1 Account Creation

To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

3.2 Age Requirement

You must be at least 18 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 18 years old.

3.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

3.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

4. Services

4.1 Service Description

Freeways UK provides courier services for the collection and delivery of Packages within the United Kingdom and, through our partners, to international destinations. Our Services include:

  • Standard delivery
  • Express delivery
  • Same-day delivery (in select areas)
  • International shipping
  • Specialized delivery solutions

4.2 Service Availability

Service availability varies by location and service type. We reserve the right to refuse service to any location or for any Package at our discretion. Service availability information provided on our website or through our customer service is approximate and subject to change.

4.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

5. Prices and Payment

5.1 Pricing

Our prices are as quoted on our website or as communicated to you at the time of booking. Prices may vary based on package dimensions, weight, destination, service level, and any additional services selected.

All prices are in British Pounds (GBP) and include applicable taxes unless otherwise stated.

5.2 Price Changes

We reserve the right to change our prices at any time. Any price changes will not affect Orders that have already been confirmed.

5.3 Payment Methods

We accept payment by credit card, debit card, bank transfer, and other payment methods as indicated at the time of booking. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that the payment information you provide is accurate.

5.4 Payment Timing

Payment is required at the time of booking unless you have an approved credit account with us. For credit account holders, payment terms are as specified in your account agreement.

5.5 Surcharges and Additional Fees

We may apply surcharges or additional fees for:

  • Fuel cost fluctuations
  • Remote area deliveries
  • Failed deliveries due to incorrect address information
  • Packages exceeding the dimensions or weight specified at booking
  • Special handling requirements
  • Other circumstances as communicated at the time of booking or in our service documentation

6. Delivery and Collection

6.1 Delivery Timeframes

Delivery timeframes provided are estimates and not guarantees unless explicitly stated otherwise. Various factors including weather, traffic, customs clearance (for international shipments), and other circumstances beyond our control may affect actual delivery times.

6.2 Proof of Delivery

We will obtain proof of delivery for each Package, which may include a signature from the Recipient or a photograph of the delivered Package. In certain circumstances, we may deliver the Package to a neighbor, building reception, or secure location if the Recipient is not available to accept delivery.

6.3 Failed Deliveries

If we are unable to deliver a Package because the Recipient is not available, the address is incorrect, or for any other reason not attributable to us, we will:

  • Attempt to deliver the Package again
  • Leave a delivery notification
  • Return the Package to our depot

After a failed delivery, the Package will be held for a maximum of 7 days before being returned to the Sender. Additional fees may apply for redelivery or return shipping.

6.4 Collection

For collection services, the Sender must ensure that the Package is ready for collection at the specified time and location. If the Package is not available for collection, additional fees may apply for rescheduled collection.

6.5 Address Accuracy

The Sender is responsible for providing accurate and complete address information. We are not liable for delays or failed deliveries resulting from incorrect address information.

7. Prohibited Items

You must not send or attempt to send any of the following items through our Services:

  • Illegal substances or items
  • Dangerous goods or hazardous materials (unless through our specialized service and with prior approval)
  • Firearms, weapons, or ammunition
  • Live animals or insects
  • Perishable goods (unless through our specialized service and with prior approval)
  • Human remains or ashes
  • Cash, bank notes, credit cards, or negotiable instruments
  • Precious metals or stones
  • Items that require temperature control (unless through our specialized service and with prior approval)
  • Any item prohibited by law, regulation, or the terms of our carrier partners

We reserve the right to refuse or return any Package containing prohibited items. If we discover that a Package contains prohibited items after collection, we may dispose of the Package or report it to the relevant authorities. You will be responsible for any damages, penalties, or fines resulting from sending prohibited items.

8. Packaging Requirements

The Sender is responsible for ensuring that each Package is properly packaged to protect its contents during transportation. Proper packaging includes:

  • Using a sturdy outer container appropriate for the contents
  • Providing adequate internal cushioning
  • Securing all openings with appropriate tape
  • Removing or covering any old labels or markings
  • Clearly labeling the Package with the Recipient's address

We are not liable for damage resulting from inadequate packaging. We reserve the right to refuse any Package that appears inadequately packaged.

9. Liability and Insurance

9.1 Liability Limitations

Our liability for loss, damage, or delay to a Package is limited to the lesser of:

  • The actual value of the Package
  • £50 per Package for standard service
  • The amount of insurance purchased

We are not liable for any consequential, indirect, or special damages, including lost profits, regardless of the cause.

9.2 Insurance

We offer additional insurance coverage for Packages with a value exceeding our standard liability limit. Insurance must be purchased at the time of booking and the actual value of the Package must be declared.

9.3 Exclusions from Liability

We are not liable for loss, damage, or delay resulting from:

  • Acts of God, natural disasters, or other circumstances beyond our control
  • Inadequate packaging
  • Inherent defects in the Package contents
  • Acts or omissions by the Sender, Recipient, or any third party
  • Shipping prohibited items
  • Customs delays or confiscation by authorities

10. Claims Process

10.1 Filing a Claim

Claims for loss, damage, or delay must be submitted in writing to our customer service department within:

  • 7 days from the date of delivery for damage or partial loss
  • 21 days from the expected delivery date for complete loss

10.2 Claim Documentation

All claims must include:

  • The tracking number
  • A detailed description of the loss or damage
  • Documentation supporting the value of the Package contents (e.g., receipt, invoice)
  • Photographs of damage (for damage claims)

10.3 Claim Resolution

We will acknowledge receipt of your claim within 2 business days and aim to resolve all claims within 30 days. For approved claims, payment will be issued to the original payer of the shipping charges unless otherwise agreed.

11. Intellectual Property

All Content included in our website and Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Freeways UK or our content suppliers and is protected by UK and international copyright laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The most current version will be posted on our website with the effective date.

Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Services.
